Under the Safety, Health and Welfare (Construction) Regulations 2012, the appointment of a Project Supervisor Design Process (PSDP) or Project Supervisor Construction Stage (PSCS) is a legal requirement for projects meeting the relevant criteria as set out in the regulations.

The project supervisor design process must be an individual or body corporate i.e. a limited company. In all cases the person or company undertaking the role must have the necessary competence to carry out the relevant duties. The project supervisor design process must be appointed before design work commences. This is to ensure effectiveness in addressing and co–ordinating safety and health matters from the very early stages of a project.

What are Notifiable Projects?

Construction has a very significant accident rate, research indicates that a lot of the risk can be designed out prior to the commencement of the activity. The Safety, Health and Welfare at Work (Construction) Regulations 2006 (S.I. No. 504 of 2006) place duties on the Client, Project Supervisor for the Design Process. and Project Supervisor Construction Stage including requirements to notify the Authority as detailed below.

When does the Project Supervisor for the Design Process Have to Notify?

It is duty of the Project Supervisor for the Design Process to notify the Authority and the client of non–compliance with any written directions issued. There is no approved form for this but notification should be in writing.

It is the duty of the Project Supervisor Construction Stage to notify the Authority before construction commences where construction is likely to take more than 500 person days or 30 working days.
